Boundaries
in BC Civil Liberties' Court
The
Campbell government has dared the BC Civil Liberties Association
to go for it, to challenge the 85 electoral boundaries which
increased the number that exceed the 25% average population
deviation rule from 4 in the Boundary Commission's recommendation
to 11 in the Campbell
government's gerrymander. On March 13th Jason
Gratl, President of the Civil Liberties Association, said:
"If the government proceeds with this plan, the BCCLA
will go to court to seek orders protecting constitutionally
guaranteed voting rights of all British Columbians from this
unconscionable attack on fundamental freedoms."
On
April 7th Attorney General Wally Oppal introduced Bill
19, 2008 Electoral Districts Act. The Bill doesn't contain
a single word to justify the decision to overrule the recommendations
of the Boundaries Commission. Its explanatory note refers
to resolution 39, which was unanimously passed on March 13th.
Opposition House Leader Mike Farnworth cautioned the government
that when debating the subsequent legislation, now introduced
as Bill 19, the Opposition would look at whether the government
had thought about a possible constitutional challenge and
that "that they have legal opinions in place to address
those issues." Don't hold your breath waiting for the
Campbell government to release its legal opinions. The question
is whether the Civil Liberties Association will act on its
promise of March 13th.
